When contracting our services, the client accepts the following TERMS AND CONDITIONS:
I. - SAFETY:
For
safety is very important, thatīs why
the operator will make a deailed inspection of the equipment previous to any
flight
a) We do not fly above people or inhabited zones
b) A 15 meter safety area will be settled down around the camera ship where only the operator will be allowed to stay
c) The operator of the airplane or helicopter will exclusively maintain communication with the camera operator to avoid to distract his attention
d) A safety zone will be designated so that in case of a malfunction of the equipment, mechanic or radio failure, the public can take shelter
e) The operator, at any moment, will have the faculty to change the flight path or to land whenever he considers some risk for the people or the equipment
f) The height and the distance to which we can fly will be limited solely by the visual conditions at the time of the flight
II. - EVALUATION OF THE SCENE:
a) The operator will make a visual inspection of the scene with the purpose of determining possible obstacles, zones of risk or interferences
b) Based on the inspection of the scene, the pilot will make a flight plan of the takings along with the client
III. - OPERATION:
a) The sessions will consist of a maximum of 4 effective hours from the arrival to the location
b) A different session will be considered when the change of location represents a transfer of the equipment to a distance of about 20 km or 30 minutes (Negotiable according to the nature of the project)
c) The flights will have a maximum duration of 10 minutes with intervals of 15 minutes for fuel charge and general equipment check and inspection
d) In case of any failure, we are able to provide a back up system at no extra charge
IV. - RESPONSIBILITY:
a) Failures or damages to the
equipment will run on behalf of
unless they are caused by not
to follow some or all of these safety rules nonimputable to us

is not responsible for any delays or problems caused by the malfunction of the
equipment, material or transport, our responsability is to restore the service
as soon as possible
b) The client will be responsible of the permissions and procedures to obtain the corresponding authorizations of access, image capture and its use for the aims to which is destined, whatever this is

responsibility is not other than to provide the service for which we are
contracted
V. - MATERIAL:
a)
will provide blank material for the accomplishment of the takings
b) The recorded material will be delivered in its original format without any treatment or edition of the images
c)
will be able to provide the service
of edition of images (Photo and Video) at an extra charge based on the
complexity of the project
d) In the case of the material in its original format the delivery will occur within a term of 2 days after the session, the edited material will require 2 additional days for its delivery
e)
reserves the right to use the images for self publicity purposes by any media
f)
will not under any circumstance sell the images to anyone who is not the client
who contracted the service
VI - TRANSFERS:
a) The transport within the metropolitan area (D.F.) is included in the cost of the services
b) The cost of the service does not include the payment of tolls, gasoline and lodging generated by transfers outside the metropolitan area (roundtrip), that will have to be provided in advance by the client
c) The transfers can not be greater than 800 km per day
d) For security reasons, transfers at night or overnight can not be more than 80 km far from its origin point
e) The nature of the equipment and the fuels that we use do not allow transfers by air
f) The transfers and sessions could not be executed the same day when the distance is greater to 300 km
g) The client will have to provide the exact address and driving directions to the meeting point or location and a map or sketch if possible
h) The great volume of our equipment
and the reduced space in our transport make imposibilta to us to transfer
any equipment other than

VII. - CONTINGENCIES, CANCELLATIONS AND DELAYS
a) It will be considered as a contingency when the climatic or location conditions are not optimal for the accomplishment of the sessions, generating a charge of 50% of the cost of the service plus transfer expenses such as lodging, fuel, tolls and per diems when this one is outside the metropolitan area. We will be able to remain in location stand by if necessary until optimal conditions are reached, based on equipment availability
b) Contingency causes are: strong
rain, fog, strong winds, low visibility conditions and others nonimputable to
like damages in the location,
inaccessible routes by different causes like closed ways, manifestations, floods
or any other factor that does not allow the arrival to the site in time and form
c) Cancellations not made before 72 hours previous to the transfer will generate a 100% charge
d) Delays will not generate any charge whenever the accomplishment of the project is confirmed in a later date, subject to equipment availability
VIII. - HONORARIES
a) Services must be paid as follows: a 50% of advance payment and 50% at master delivery
b) The service will be considered as confirmed when receiving the advance payment, before that, the dates will remain open and subject to availability
c) We will not reimburse any payment for any reason
d) The costs of transportation and lodging will have to be covered when the advance payment is made. We will keep all the invoices, tickets and receipts, which will be given at material delivery
e) Any other aspect of the service not contemplated in this document will be added to the final balance
f) All our costs generate a 15% tax, not inlcluded in the published rates
